Creative Cost-sharing Arrangements Benefit Contractor

A blasting contractor regularly signed broad indemnification agreements in favor of their clients. Significant claims emerged from these operations, not necessarily due to the contractor’s negligence, but due to the mere involvement of blasting. McGriff worked with the contractor and their attorney to develop a strategy for modifying contract language to include cost-sharing arrangements with their customers. The contractor now only indemnifies for their negligence and shares costs with their customers. Both parties interests are aligned and have a little “skin in the game” as well.
